NOVELL FILES SOFTWARE PIRACY SUIT AGAINST TRIDENT INTERNATIONAL, INC.

OREM, Utah -- November 1, 1995 -- Novell, Inc. announced it has filed a civil action suit in the U.S. District Court for the District of Massachusetts against Trident International, Inc., a software reseller based in Natick, Massachusetts. The suit alleges infringement of Trademark and Trade dress as well as fraudulent abuse of Novell's Upgrade License Program.

The suit follows Novell's discovery of counterfeit versions of the NetWare# network operating system were being sold into Europe and the Middle East from the United States. A series of test purchases revealed that the tampered product was supplied to Persona Group PLC in the United Kingdom by Trident International, Inc.

A follow up test purchase originating in the United Arab Emirates (UAE) from Trident International, Inc. revealed Novell upgrade product that had been re-labeled and placed in counterfeit packaging to give the appearance of Novell original product.

David Bradford, Novell Senior Vice President and General Counsel, said "Novell continues its campaign to aggressively pursue sanctions against individuals and companies that pirate our software, misappropriate Novell intellectual property, or otherwise victimize our customers. Novell is determined to protect our copyrights worldwide. We will continue to protect the integrity of our upgrade program."
