Novell Files Software Piracy Suits Against 17 Companies In California

OREM, Utah -- February 5, 1996 -- Novell, Inc. announced it has filed a series of civil action suits in the U.S. District Court for the Central District of California Western Division against 17 California based companies. The suits allege that the defendants were fraudulently obtaining Novell upgrades and/or counterfeiting NetWare boxes to give the appearance of new product.

The complaints name Softcom Computers, Software Distribution Center, Patio Computer Sales, Allnet Computers, Advanced Digital Corp., Advanced Interlink Corp., Grand Software Corp., SAB Engineering, Digital Soft, Digital Soft Technologies, Inc., Digidrive, Digidrive, Inc., Softsel, Vandy Micro Corp., Accord Systems, Inc., Jaco Electronics, Inc., all of the Los Angeles/Orange County area as well as Micro Supply, Inc. in the Silicon Valley.

The suit follows Novell's discovery that the altered upgrade product was being sold worldwide. Novell investigators have obtained the product from several different areas including Indonesia, the United Kingdom, United Arab Emirates, as well as the United States.

Ed Morin, Manager of Novell's Anti-Piracy program, said "Novell maintains a sophisticated product tracking system which has allowed us to trace this product and prove that the defendants have defrauded Novell intentionally. Novell continues its ongoing efforts to protect the customer and the sales channel from this abuse."

According to the Business Software Alliance (BSA), software piracy cost the industry $15.2 billion in sales during 1994. Novell is a member company of the BSA and supports its efforts at combatting software piracy.
