Novell and Trident International Settle Lawsuit OREM, Utah -- March 26, 1996 -- Novell, Inc. and Trident International, Inc. announced they have settled a civil action suit filed October 13, 1995 in U.S. District Court for the District of Massachusetts. The lawsuit arose from charges that Trident was selling counterfeit versions of the NetWare® network operating system into Europe and the Middle East from the United States.In the settlement Novell agreed to drop any monetary damages against Trident International, Inc. while Trident agreed to continue aiding Novell in its ongoing investigation. Trident has already provided Novell with assistance which helped Novell obtain information critical in their recent filing of lawsuits against 17 California based companies. Ed Morin, Manager of Novell's anti-piracy program, said "Novell appreciates the straightforward way Trident has cooperated in this investigation. We now know that Trident unknowingly purchased tampered NetWare from companies that are defrauding Novell's upgrade policies." Harold S. Sauer, President and CEO of Trident International, Inc. said "Trident operated in good faith and cooperated with Novell once we realized there was a problem. We recognize Novell as an industry leader in their fight against software piracy and will continue to assist their efforts." Novell is a member of the Business Software Alliance (BSA) as well as the Software Publisher's Association (SPA), organizations devoted to fighting software piracy while promoting the growth of the software industry. Last year alone, the BSA estimated that software publishers lost over $15.2 billion as a result of software piracy.
