Novell Issues Warning and Takes Action Against Two System Integrators

Agreement to Help with Further Anti-Piracy Investigations

Singapore -- June 5, 1996 -- Following a complaint from an end-user, Novell has taken strong action against two system integrators.

The user paid for the installation of NetWare for 25 users. A systems integrator defrauded the user by installing a pirated copy of NetWare which did not come with related manuals and disks. When the user insisted on being provided with them, the systems integrator colluded with another reseller to provide the unsuspecting user with an upgrade pack and installed this upgrade version over the pirated copy of NetWare. The two had hoped that with the manuals and disks in the upgrade pack, the user would not enquire further.

The situation came to light when the user made enquiries with Novell. The Anti-Piracy Group investigated this case and found the two installed versions. As an upgrade pack can only be sold to a user with legitimate version of NetWare, both installations were illegal. On being informed of this, the defrauded user gave details of the two dishonest systems integrators.

As a result of investigations, legal action was instigated against the offending systems integrators. They opted to settle the case out of court and undertook not indulge in such activities again. In addition, both have agreed to provide a legitimate version of NetWare to the user and assist Novell in further anti-piracy investigations to help trace and eliminate the source of the pirated copies.

"Novell views such cases seriously," said Weiming Chua, Novell's Licencing Manager for the Asia Pacific. "It is a clear cut case of cheating where an innocent user, who paid for and expected an original, was provided illegal copies."

Users who suspect they have pirated copies of NetWare can call the Novell Hotline at 1800-872-2480 or e-mail their serial number to pirates@novell.com. Novell has an exhaustive database that includes serial number tracking of products and registered user. With this database, Novell can pinpoint where shipments of its products were sent. If a copy is pirated, Novell can inform the user immediately and conduct investigations with a view to assist the user. Users can also call us for a free list of our authorized resellers who will ensure that they get genuine software.
