Novell Files Lawsuit Disputing Adtech Authorization Claims
OREM, Utah -- November 15, 1996 -- Novell, Inc. announced it has filed a
lawsuit in the U.S. District Court for the Eastern District of California against Adtech Network
Services, Inc., a company based in Ceres, California. The suit alleges Trademark and Trade name
infringement by Adtech Network Services, Inc.
Novell's complaint alleges that Adtech Network Services, Inc. is fraudulently claiming to be a
Novell authorized reseller in its advertisements as well as claiming that a certain employee is a
Novell CNE. Novell has no record of Adtech Network Services, Inc. ever applying to become a
Novell authorized reseller, and Novell's records indicate that the employee has only taken one
course towards obtaining his CNE status.
Harrison Colter, a Novell attorney, said "Novell must be aggressive in protecting our trademarks
and trade name. Repeated attempts to resolve this problem have been ignored and we will protect
the integrity of our sales channel. Novell will not allow companies or individuals to make claims
that confuse the honest customer nor will we allow any infringement of our trademarks."
