Novell's Focus on Upgrade Abuse Pays Off Again in $130,000 Lawsuit Settlement
PROVO, Utah -- August 20, 1997 -- Novell, Inc. announced it has reached a
settlement of $130,000.00 in its complaint against Super Resources of San Jose, California.
The case was first filed in the United States District Court, Northern District of California, San Jose
Division in February of 1997. Novell's original complaint alleged that Super Resources, also known as
High Tech Mart, had been filling out upgrade forms using the same original serial number in order to
receive multiple upgrades.
Novell's anti-piracy group has negotiated over $2 million in settlements involving companies trying to
defraud Novell's upgrade policies during 1997.
"We have focused some of our efforts of the past two years on the upgrade abuse problems and this focus
is now paying off," stated Harrison Colter, associate general counsel for Novell. "This is just another
example of the steps Novell will take to protect the integrity of its sales programs."
More than $11 billion each year is lost to software piracy, according to the Business Software Alliance
(BSA) and Software Publisher's Association (SPA). Novell investigates more than 500 cases worldwide
every year. Novell is an active member of both the SPA and BSA.
