Novell Awarded Judgment in Software Piracy Suit

Defendants Ordered to Pay Novell More Than $3 Million

PROVO, Utah — June 21, 2002 — Novell, Inc., the leading provider of Net business solutions, today announced that it has received a sizeable judgment against Joseph Robertson and Gino Barrett of Georgia, and Robb Adams of Florida. Novell brought a suit against the three individuals and their related companies, Puhr Entertainment Group and ACL Learning Centers, approximately two years ago for copyright and trademark infringement.

In the lawsuit, filed in the U.S. District Court for the Northern District of Georgia, Novell alleged that the defendants submitted falsified records to Novell in order to fraudulently acquire discounted Novell products that were designated for qualified educational institutions. As part of the scheme, the defendants falsely represented themselves as educational institutions on multiple occasions, using several fictitious names. The suit alleged that the defendants acquired hundreds of these products and then advertised and distributed them as though the products were acquired legitimately.

The fraudulent activity took place over a short period of time before Novell's internal controls discovered the improprieties and Novell's investigators pursued the matter. In its decision, the Court ruled that the defendants engaged in trademark infringement, false advertising, and deceptive trade practices. The Court also ruled that the defendants willfully infringed Novell's copyrights and ordered them to pay Novell more than $3 million in compensatory and statutory damages.

"It's disappointing that these individuals tried to take advantage of a program designed specifically to benefit educational institutions," stated Ed Morin, Novell's anti-piracy manager. "We're pleased that the Court ruled in Novell's favor and upheld its intellectual property rights."
